The Site offers a platform that links independent contractors with customers who need their services ("Clients").
  2. 1.2 You accept and agree, on your own behalf or that of your employer or another entity (if applicable), to be bound by and abide by these Terms of Service and the Fiverr Payment Terms, which may be found here ("Payment Terms") and are incorporated herein by reference, by using the Site, creating an account, or clicking to accept or agree to the Terms of Service when this option is made available to you. 2. Definitions and Terminologies

  5. 2.5 "Intellectual Property Rights" means all patents, copyrights, trademarks, trade secrets, and other proprietary rights recognized in any jurisdiction, including all applications and registrations therefor.
  6. 2.6 "Service Agreement" means a separate contract for the supply of Services between a Freelancer and a Client that is made if the Freelancer accepts a project proposed by the Client.
  7. 2.7 "Services" means the services offered by Freelancers on the Site, as described in the Freelancer’s profile and in the Service Agreement.
  8. 2.8 "Service Fee" means the fee charged by the Site to Freelancers for using the platform to find work, which is a percentage of the total project value.
  9. 2.9 "Site" means the freelance website operated by the Company, including all content and services offered on the Site.
  10. 2.10 "User" means any individual or entity that accesses or uses the Site, including but not limited to Clients and Freelancers.
  11. 2.11 "Website Content" means all text, graphics, logos, images, software, and other materials available on or through the Site.
  12. 2.12 "Your Content" means any and all information, data, text, images, videos, or other materials posted, uploaded, or otherwise provided by you to the Site.
  13. 2.13 "We", "us" or "our" means the Company and its affiliates, officers, directors, employees, and agents.

3. Registration

  1. 3.1 The user needs to register for an account in order to access certain features of the freelance website.
  2. 3.2 Throughout the registration procedure, the user undertakes to provide authentic, current, and comprehensive information.
  3. 3.3 The user is exclusively in charge of protecting the privacy of their account and password.
  4. 3.4 The user promises to report any illegal use of their account or password to the freelance website right away.
  5. 3.5 Selflance Freelancing Platform retains the right to refuse registration of users it deems improper or objectionable or to terminate existing accounts.

4. General Rules of Conduct

  1. 4.1 User agrees to use the Selflance Freelancing Platform only for lawful purposes and in a way that complies with any laws or regulations that may be in force.
  2. 4.2 User acknowledges that using the Freelance Website in a manner that infringes on the rights of any third party is prohibited.
  3. 4.3 The user commits to refraining from any actions that might damage or impair the Freelance Website, its servers, or its networks.
  4. 4.4 User agrees not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the website.
  5. 4.5 User agrees not to engage in any fraudulent activity, including but not limited to providing false or misleading information, engaging in fraudulent transactions, or engaging in any activity that might financially affect the site, its users, or its affiliates.
  6. 4.6 The Users shall bear the following into consideration:
    • You will not use, possess, or advocate for the sale of any intoxicants such as alcohol or narcotics.
    • You will not partake in any gambling or speculative activities.
    • You will not promote pornography in any way or partake in any sort of illicit sexual activity.
    • You will not partake in any interest-based or usury-based activities.
    • You will respect other people's privacy and refrain from using or disclosing their personal data without their authorization.

5. Seller Obligations

  1. 5.1 Seller accepts these Terms of Service by providing services on the Selflance Freelancing Platform.
  2. 5.2 The Seller accepts responsibility for providing accurate and thorough information about the services provided, including but not limited to service descriptions, costs, and turnaround times.
  3. 5.3 The Seller promises to deliver the services the Client has paid for promptly and expertly.
  4. 5.4 The Seller promises to correspond with the Client in a timely and professional manner.
  5. 5.5 The Seller commits to provide services on the Site in accordance with all applicable laws and regulations.
  6. 5.6 The Seller recognizes and accepts that the Site is not accountable for the caliber, correctness, or legality of any services rendered by the Seller.

6. Buyer/Client Obligations

  1. 6.1 Client accepts these Terms of Service by making a purchase on the Selflance Freelancing Platform.
  2. 6.2 Client undertakes to give accurate and thorough information, including but not limited to service descriptions and payment details, about the services that have been purchased.
  3. 6.3 The client consents to promptly pay for the services they have ordered on the freelance website.
  4. 6.4 Customer consents to timely and professionally communicate with the Seller about the services ordered.
  5. 6.5 The client understands and accepts that this site is not liable for the quality, authenticity, or legality of any services rendered by the Seller.
  6. 6.6 Client recognizes and acknowledges that the completion or availability of any services ordered is not guaranteed by the site.

7. Gigs

  1. Our website gives independent Sellers a platform to propose and carry out services to clients (referred to as "Gigs"). Gigs on our website are subject to the following conditions:
  2. 7.2 Gig Creation: Freelancers can create gigs by describing the services they are offering, listing the cost of those services, and including any other pertinent details. The accuracy and comprehensiveness of the information presented in Gigs must be upheld by Sellers.
  3. 7.3 Gig Payment: At the time of purchase, buyers are required to pay the full amount of the gig price. Until the work is finished, and the buyer has approved it, we will withhold the payment. Once the Gig has been approved, we will deliver the money to the Sellers, less our commission.
  4. 7.4 Delivery of Gig: Sellers are in charge of completing the Gig in accordance with the conditions outlined in the Gig description. The buyer may ask for the assigned work to be changed or canceled if it is not delivered on time or does not satisfy their needs. We may issue a refund to the buyer or take other necessary steps if the product is not delivered on time or is of bad quality.
  5. 7.5 Gig Modification: If the initial conditions are not met or if revisions are necessary, Sellers and clients may ask for a Gig to be modified. Before the cash is delivered, the Seller must consent to the modification request and the buyer must accept the modified Gig.
  6. 7.6 Gig Cancellation: Sellers and clients may cancel a gig if they are unable to adhere to the original conditions or if any other problems occur. Depending on the conditions, the buyer may be eligible for a refund if they decide not to complete the Gig. There may be penalties or account suspension if the freelancer cancels the Gig.
  7. 7.7 Gig Ownership: The seller is the sole owner of the content of their gig and is free to use it for their own promotional needs. Nonetheless, the customer retains full rights to use the content for their own purposes after the Gig is provided and accepted by the buyer.
  8. You accept responsibility for adhering to these terms and any additional regulations or guidelines placed on our website by providing or purchasing Gigs there. These terms are subject to change at any time, and we will always let users know if there are any significant changes.

8. Level System and Recognition

  1. 8.1 For the purpose of recognizing and rewarding our top freelancers, our website provides a Levels system. Levels on our website are subject to the following conditions:
  2. 8.2 Freelancers must fulfill criteria to advance to higher levels, such as finishing a certain number of Gigs, maintaining a high rating, or making a certain amount of income through our website.
  3. 8.3 Higher Levels provide a variety of advantages, like better visibility, faster service, or access to exclusive features. Depending on the freelancer's Level and our policies, the benefits may change.
  4. 8.4 Freelancers must continue to complete the requirements and follow our regulations in order to keep their Level status. We reserve the right to change a freelancer's Level or revoke their Level status if their actions or performance fall short of our expectations.
  5. 8.5 A freelancer may get in touch with us to ask for a review if they disagree with our determination of their Level status. We will examine the situation and, if necessary, revise the freelancer's Level.
  6. 8.6 You agree to abide by these conditions as well as any other policies or guidelines issued on our website by taking part in our Levels system. We have the right to revise these conditions at any moment and will let users know if there are any significant changes.

9. Cancellation and Retention of Funds

  1. 9.1 If an order is canceled and its value is equal to or greater than $20, the money will be kept in the user's account on the freelancing website and will not be returned to them.
  2. 9.2 Retained money cannot be withdrawn or transferred to another account or payment method; it may only be used to pay for services on the website.
  3. 9.3 In the case that the User chooses to spend the retained funds on a service, the User must choose a service that costs at least as much as the retained funds.
  4. 9.4 No other promotional offers, discounts, or credits may be combined with retained funds.
  5. 9.5 The Retention of Funds Policy may be changed or discontinued at any time Selflance Freelancing Platform, with or without prior notice to the User.
  6. 9.6 By utilizing the services of the website, the User accepts and agrees to the Terms of Service's retention of funds policy.

10. Commission Fee for Buyers

  1. Commission Fee for Buyers Customers who use our platform will profit from a special offer of our service, which is the lack of commission costs when hiring services from our skilled sellers. Thus, when utilizing our platform to connect with freelancers globally, customers can expect a straightforward and affordable experience. We are committed to providing a fair and equitable environment for all users and charging buyers zero commission fees is just one example of how we do this.

11. Custom Offers and Agreement Forms

  1. 11.1 An agreement form must be included with every custom offer submitted by a seller on the Selflance Freelancing Platform. The project's scope, completion date, and the agreed-upon price will all be specified in this agreement form.
  2. 11.2 The agreement document must be completed and consented to by the client before any work on the project can begin. This will serve as evidence that the client has read, understood, and accepted the project's conditions as set forth in the agreement form.
  3. 11.3 Seller will only start working on the project if the client completes and consents to the agreement form.
  4. 11.4 The Seller will submit the work for evaluation and final approval, once the task has been finished, to the client's satisfaction.
  5. 11.5 The client will have to pay for the services provided once the finished product has been accepted. According to the payment terms stipulated in the agreement form, payments will be sent using the payment system of this platform.
  6. 11.6 Both buyers and sellers acknowledge and agree to the requirement for an agreement form for custom offers and to the terms mentioned in the agreement form by consenting to utilize this platform’s services.

12. Order Cancellation for Failure to Meet Requirements

  1. 12.1 The buyer has the right to ask for an order cancellation if the seller fails to fulfill an order in line with the specifications provided by him.
  2. 12.2 The Seller will have the chance to make changes to the work and fulfill the buyer's demands. The buyer may go ahead and cancel the order if the seller is unable to fulfill the conditions within a reasonable amount of time.
  3. 12.3 Both buyers and sellers recognize that orders must be fulfilled in accordance with the specifications provided by the buyer and that orders must be executed in accordance with the parameters described in this clause by this platform’s services.

13. Advertising Guidelines

  1. 13.1 On the freelance website, sellers are free to advertise their goods and services to potential clients.
  2. 13.2 Advertising must be done in accordance with the community standards of Selflance Freelancing Platform and must not support inappropriate, illegal or harmful content.
  3. 13.3 Advertising fees will be assessed in accordance with the time and price parameters provided by this platform. While posting adverts, sellers must follow these rules.
  4. 13.4 Any advertisements that transgress our community standards or terms of service may be removed by Freelance Website.
  5. 13.5 Both buyers and sellers understand and agree to these advertising standards by utilizing Freelance Website's services, and they also agree to abide by all of the site's community standards and policies.

14. Orders and Payments

  1. 14.1 By placing an order with a Seller, a client may purchase services on the Selflance Freelancing Platform.
  2. 14.2 The client agrees to pay for all Orders placed on the website, together with any applicable taxes or fees.
  3. 14.3 Until the Seller provides the Client with the ordered services, Selflance Freelancing Platform will keep the funds for each Order.
  4. 14.4 The site will release the funds to the seller after the services have been rendered, less any necessary costs.
  5. 14.5 Any Order or transaction that Selflance Freelancing Platform finds unsuitable or fraudulent may be terminated.

15. Applicable Fee and Costs

  1. 15.1 For the usage of its platform and services, Selflance Freelancing Platform charges a fee.
  2. 15.2 With or without prior notification to Users, the site retains the right to amend its price schedule at any moment.
  3. 15.3 The funds released to the Seller for each order will be deducted by the website's fees.
  4. 15.4 The Seller accepts responsibility for paying all applicable taxes or fees on earnings generated through the freelance website.

Intellectual Property

Ownership

16.1 User acknowledges and accepts that all legal rights, title, and interest in and to the Company, including any intellectual property rights that may exist therein, are owned by Selflance Freelancing Platform and its licensors. Any copyright and trademark notices that may be attached to or contained within the site are not to be removed, obscured, or altered by the User.

User Content

16.2 Any User Content that the User publishes to Selflance Freelancing Platform shall be the sole property of the User. User grants the Company a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, generate derivative works of, display, and perform User Content in conjunction with the operation of Freelance Website and its services.

Third-Party Content

16.3 User acknowledges and concurs that third-party content may be covered by intellectual property rights held by the third-party content provider. This includes but is not limited to, text, images, graphics, logos, and software. Without the express prior written agreement of the third-party content provider, User agrees not to copy, edit, reproduce, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any third-party content.

Copyrights

16.4 Selflance Freelancing Platform respects the legal ownership of others' work and demands that its users do the same. If a user thinks that their work has been copied illegally, they should give the following information to the copyright agent of the website:

  • User's contact information, including User's address, phone number, and email address.
  • A description of the copyrighted work that User claims has been infringed.
  • A description of where the allegedly infringing material is located on the Site.
  • A statement by User that User has a good faith belief that the disputed use is not permitted by the copyright owner, its agent, or the law.
  • A declaration by User, made under penalty of perjury, that the above information in User's notice is accurate and that User is the copyright owner or authorized to act on the copyright owner's behalf.

Trademarks

16.5 The user understands and agrees that the Company or its licensors are the only owners of all trademarks, service marks, logos, and trade names shown on the website. Without the prior written consent of Selflance Freelancing Platform, User agrees not to use any of the Company’s trademark, service mark, logo, or trade name in connection with any good or service that is not provided by it.

17. Limitation of Liability

17.1 Any damages, including but not limited to direct, indirect, incidental, punitive, and consequential damages, of any kind resulting from the use of this website are not the responsibility of the Company.

17.2 The user understands and agrees that the website is not responsible for any losses brought on by unauthorized access to or alteration of the user's transmissions or data.

17.3 Any losses brought on by the inability to utilize Selflance Freelancing Platform or any lag in accessing or using the website shall not be the responsibility of this platform.

18. Indemnification

17.1 User agrees to indemnify, defend, and hold harmless Selflance Freelancing Platform, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms of Service or any activity related to User's account.

19. Termination

User Termination

19.1 User may cancel User's account and User's use of Company’s services at any time, for any reason, by adhering to the instructions on the website or by getting in touch with website customer care staff. Upon termination, User's account will be deactivated, and the User's use of the services provided by the website will end.

Termination of User Account by Website

19.2 This website retains the right to deny Users access to its services and to their accounts at any time, for any reason, and with or without prior notice. If the website terminates the User's account, the User will be notified by email or by other methods of contact.

Effect of Termination

19.3 The user will lose access to User's account and User Content when User's account is terminated. All parts of these Terms of Service that by their nature will survive termination, including but not limited to Sections relating to Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.

19.4 If the Company closes User's account without explanation, the website will reimburse User for any unused credits or fees paid to the platform. User will not be entitled to any refund of credits or payments made to the Company in the event that User terminates User's account, or this platform terminates User's account for cause (including but not limited to violation of these Terms of Service).

20. Governing Laws and Jurisdiction

20.1 The laws of the country in which this website operates shall govern these terms of service and be followed in their interpretation.

20.2 The courts in the country where the Company is based shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms of Service or the use of this platform.

21. Entire Agreement

21.1 Any former or current discussions and proposals, whether oral or written, between User and Freelance Website are superseded by these Terms of Service as the complete agreement between User and Freelance Website with regard to the use of Freelance Website.

21.2 To the same extent and subject to the same restrictions as other business documents and records originally generated and maintained in printed form, a printed version of these Terms of Service and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms of Service.
